Claims Scenario:
EXTENDED BUSINESS INCOME

A mid-rise apartment building in Virginia suffered a large fire loss, caused by a faulty space heater. Forty-five of their one hundred units were deemed uninhabitable. The damages took nearly fourteen months to repair mainly due to lead and asbestos abatement. It took another seven months to reach pre-loss occupancy levels. The ownership found out the hard way that their insurance policy only offered 30 days of Extended Business Income which led to an out-of-pocket expense of $297,488.

A real estate owner signed a roofing contract without reviewing the indemnity and limitations of liability provisions. The roofing company included favorable language such as "gross negligence" which dramatically limited their contractual exposure and liability to the cost of the job (approx. $120,000). During the renovation project, materials fell from the roof and severely injured a tenant. The tenant filed a lawsuit, naming both the roofing contractor and the property owner.
